§2905.40. Legal Authorization to Work

  • In order to be eligible to receive benefits, an individual must be available to work (see Section 500C of the Act).  In order to meet this availability requirement, an alien must be legally authorized to work in the United States.  An alien without current authorization to work from INS or who is not in a status that automatically permits the alien to work, is not legally available for work and not eligible for benefits, even if the alien meets the monetary eligibility requirements of Section 500E of the Act.
