§1130.635. Additional Information Provided During the Review Period

  • a)         Additional Information

     

    1)         During the review period, HFSRB may request information or data from the applicant or from other persons to clarify the application and conduct the HFSRB staff review. 

     

    2)         The applicant may also submit information or data if the information is:

     

    A)        due to a modification of the project; or

     

    B)        in response to an Intent to Deny, or in response to a request from HFSRB. 

     

    3)         All additional information shall be submitted to HFSRB's staff in writing, on 8½" by 11" paper.

     

    4)         All additional information shall be submitted within the required time frame established in subsections (b) and (c) and shall be sent only by any recognized overnight courier or personal delivery service.

     

    5)         Additional information submitted by fax or email will not be accepted.

     

    6)         All additional information shall be made part of and included in the project record.

     

    b)         Public Comment Information

    Public comment information from persons other than the applicant that were submitted in accordance with the public comment and public hearing provisions of this Part shall not be considered requested or additional information.  The information shall be made part of and included in the project record.

     

    c)         Public Response to Staff Review and Findings

    The applicant and members of the public may submit, to the State Board, written responses regarding the facts set forth in the review or findings of the Board staff or reviewing organization.  Members of the public shall submit any written response to the staff review and findings at least 10 days before the meeting of the State Board.  The staff may revise any findings to address corrections of factual errors cited in the public response.  At the meeting, the State Board may, in its discretion, permit the submission of other additional written materials.     d)         Ex Parte Information

    HFSRB will comply with the requirements of the Act pertaining to ex parte communications.  (See 20 ILCS 3960/4.2.)
