§750.469. Phase VI - Remedial Action - Extent of Remedy

  • a)         The appropriate extent of remedy shall be determined by the IEPA's selection of the remedial alternative which it determines is cost-effective (i.e.  the lowest cost alternative that is technologically feasible and reliable and which effectively mitigates and minimizes damage to and provides adequate protection of public health, welfare, or the environment).

     

    b)         The need for protection of public health, welfare and the environment at the facility under consideration should be balanced against the amount of money available in the Fund to respond to other sites which present or may present a threat to public health or welfare or the environment, taking into consideration the need for immediate action. Accordingly, in determining the appropriate extent of remedy for Fund-financed response, the IEPA also must consider the need to respond to other releases with Fund monies.
