§101.404. Agency as a Party in Interest

a) Under Section 30 of the Act, the Board may request that the Agency investigate:
1) Any alleged violation of the Act, any regulations adopted under the Act, any permit or term or condition of a permit granted by the Agency, or any Board order; and
2) Any other matters as the Board finds advisable.
b) Upon a request under subsection (a), the Board may designate the Agency as a party in interest in any ongoing proceeding concerning that matter. The designation of the Agency as a party in interest does not require the Agency to take a position on the merits of the proceeding.
